I got a call today from Lt. Steven Murphy from the County sheriff‘s office with a bench warrant for me missing jury duty for a Federal Grand Jury. County Sheriff’s department was coming to arrest me for 2 cl**s B misdemeanors unless I request a (BWUP) Bench Warrant Upliftment Procedure. Lt. Murphy claimed an agent of the Federal Gov’t visited our house on December 18th and that I signed or someone at our residence signed a Jury Affidavit affirming I have been notified that I should appear for Federal Grand Jury selection during the first week of February 2025. Since I did not appear, a bench warrant had been issued by the federal Gov’t and the arresting duty had been delegated to county Sheriff’s department to execute the warrant. The reason for the phone call was to ask if I would turn myself in at the county jail to avoid sending a unit to my house to arrest me. He went on to say that I could request at this time under Code Section 2-20-63A a BWUP (Bench Warrant Upliftment Procedure). I asked what that was and he explained basically the warrant will be lifted and no arrest would be made but you would have to appear for court to be sentenced for the charges. I asked if this is kind of like a bond and he said no because a bond occurs after you have been charged, arrested, and appear for the arraignment. This avoids all of that. I asked him to explain how the BWUP works. For the BWUP to become effective I would need to visit one of the OC (Office of the County) Kiosks located at various locations in the County. These Kiosks offer those that have fines for misdemeanors, parking, or traffic fines an easier way to pay without stepping onto County Govt property. If I were to appear on any Gov’t property as of today, I will be taken into custody for the two charges so it would be better and safer for me to pay the charges offsite at one of the Kiosks. The Kiosk is located at this address.
